How to Minimise The Risk of Being ‘Scammed’ When Buying On Clio197/200.net.
‘If something looks too good, it probably is’.

The first thing to do is gather as much information about the seller as possible; these may be used both for security and contact reasons. So what information do you need, why do you need it, and what can you do with it.

Full Name Their full name would be useful in order to verify their identity so that you know exactly who you are buying off, should you need to write a formal letter to them in due course, or attempt to track them down. You may also be able to search for them on the likes of FaceBook, Bebo, etc in order to get an insight into whether or not this is their real name, or a false one that they’ve made up in order to make a quick dollar. Use your initiative and common sense.

Phone Number This is an obvious one, and very easy to verify. Ask for a contact phone number so that you can get hold of them in case of abrupt importance, or confirmation of anything. If they give you a phone number, ask them if you can quickly call to verify that it is their right number in order to avoid later upset. If they’re genuine, there shouldn’t be any problem in doing so.

E-mail Address Another form of contact is an e-mail address, ask them for their e-mail address, should you need to contact them. Send them a quick e-mail again to verify that you have got a real address and not a bogus one.

Home Address Possibly the most important piece of information that you should get is their address, afraid to say, without this there is little that you can do should you be scammed. If your transaction is for a significant amount you should get the address verified.

With all of the above, if the seller is genuine he or she will have no problem in giving out information like this, without good reason, if they do seem to hesitate, you should question the transaction before handing over your hard earned cash.

Methods of Payment
What’s the safest way?

Cash on collection is by far the safest way to pay for your goods, although it’s not ideal for everybody. You can look at them, check them over, if they’re satisfactory, great, you’ve got a bargain, hand over the cash load them into your boot and you’re a happy chappy.

2.2
Paypal. Please don't pay people via a 'Personal Gift' with out making sure the items are going to be posted or you have 100% correct contact information.

You cannot make a Paypal case if you pay via this method, and you could lose all your money.

Make sure you have a full address, contact number and also if need be, arrange your own courier pick-up of the items.).

Cheque what’s one of them you’re thinking? A cheque is a fine method of payment as with it, it carries a history of the transaction as it shows up on your bank account what payment were made when, great! If there is a dispute about the payment history, this can easily be chased up and proven upon production of a recent statement.

Great, so you’ve encountered a money grabbing tw@ and he’s on the run, but it’s cool because you did everything as mentioned above... right? Well if you didn’t you have little hope of getting your money back, and you’re now probably sitting there feeling pretty damn stupid. Hate to say it but you are, it’s probably your own fault. If you did get their contact details, then it should be fine. When ‘chasing up’ a purchase please remember to give members adequate time to reply to your messages as such, as scary as it is, people do have a life off of Clio197/200.net and may also be suffering from incidents in their life, unknown to you, just use common sense.

If you believe that you have been scammed and are in trouble, with the right information, there are ways to resolve the situation. If you’ve paid by PayPal you can use their online ‘Transaction Settlement Facility.’

If however you feel that you need to get a bit more serious and that you truly are a victim of fraud you need to act upon it. The easiest way is to issue court proceedings against them in the small claims court.

Small Claims Court – A Brief Outline
Don’t panic, it’s easy.

Ideally, the last thing that you ever want to do is get the courts involved, this should only be used as a matter of last resort. If you feel that you have done your utmost to recover you the money owed to you, with no avail, this may be a good option for you.

Let’s quickly clear up some issues to do with the small claims court.
Do I need a solicitor?
No
I can’t afford to pay the fees!
You can issue proceedings from as little as £25. If you win your case, these fees are recovered from the other side
I don’t want the hassle!
It’s very easy and your claim can be underway within minutes
I can’t be bothered with all of the paperwork!
You can do it all online, it’s laid out in a simple and easy to understand manner, with a big FAQ guide
I can’t be bothered to write a letter, or don’t know how.
The letters to the defendant are all automatically drafted and posted on your behalf, from their local court
Why bother?
The idea behind court proceedings is to get the law involved and on your side, this by no means suggests that as soon as you issue proceedings, you’re going to go to court. There are quite a few stages before this action, such as a letter from the courts that may make the defendant buck up their ideas and opt for an out of court settlement. In which case, you’ve got what you wanted, and you’ve not gone to court, bonus! Ultimately, nobody wants to go to court, and luckily most cases are settled beforehand.

Where do I start?
You can manage it all online where you can track the status of the claim as the days go on, the best service to use is ‘Her Majesty’s Court Service – Money Claim Online’. I personally have used this before and it is absolutely wicked, easy to use and very effective. https://www.moneyclaim.gov.uk/csmco/index.jsp
Registration is simple and takes just a few minutes, the system just collects personal details such as name, address etc... Once this is set up it you can click ‘start new claim’. From here it will take approximately 10 minutes to get your claim up and running. As soon as you have done this a letter on your behalf will be posted to the defendant where they are given choices of action.

What happens now
After being issued with a letter from the courts, the defendants will either:

Get scared that the courts are involved, and pay your money, as this is now a legally enforceable matter, not a PM from Clio197/200.net which is easily ignored. Once they’ve paid your money in full and on time and you’re happy, you can update the status on the website so that no further action is to be taken.

4.3.2
Dispute the facts of the case which will be sent back to you to review and resolve,if you can’t resolve the matter and the facts are disputed, you may end up going to court.

4.3.3
Ignore the letter. If after 14 days you do not get a reply, the online management system will automatically give you a default win where they have no choice but to pay you the money, in whatever format you desire. Instalments, lump sum etc... If they do not keep up the payments, the courts can enforce further action.

Contact (PM) any of the Clio197/200.net admin to keep them informed of any problems. Best to update them with proceedings so that the rest of the Clio197/200.net members are not caught out/scammed by the same member
