Dented bonnet...great!

I for one won't be using them , that doesn't help you in your situation though mate , I do strongly recommend a letter of a legal solicitor , it shows that 1 your not taking this laying down 2 it's a legal letter to wich they will have to sign for so you y know they have recieved it 3 it can outline the law for them and also your strong case that you have got going in your favour and yes also that you are going to go to the local press , your a real hard working lad , your car is your pride and joy , member of numerous car forums , etc etc lay it on thick , if the ******s still refuse well legal action will be required ,I run a small haulage company I could well do with out the grief . If it was me . If they ain't got the legally required insurances , well in my eyes they are then trading illegally , I pay thousands every year on them , I have too as its illegal to operate other wise ,and if all else fails tell me the address I will back my trailer through there shop lol !! If all else fails that will piss them off

To Whom it may concern,

As outlined in my post this afternoon on the FaceBook page, during Saturday evening I was parked at the rear of Papa Johns, Caterham, Surrey.

Whilst I was in the car, 2 large (full) bottles of Tango were dropped onto my bonnet. This was from a height as from the rear of the store you go along a path and down some steps to get to where cars are parked. Would guess at 10ft above where i had parked.

The employee was only a couple of metres from the back door. He was wearing Papa Johns uniform, it was during working hours, whilst carrying out work duties and with Papa Johns stock.

Other members of staff then proceeded to appear, all of whom we spoke to said it would certainly be delt with and full liability will be accepted.

I was advised the Regional Manager would personally call me to discuss the way forward - yes, I understand it was over Easter holidays - but as of Tuesday afternoon still no word.

I therefore contacted the Papa Johns head office who gave me the store owners mobile. Upon calling him, he only advised "I don't know, I was not there. I'll get the guy you spoke with to call you". I have been a manager within retail myself and personally don't find this very professional. The manager / store owner should be fully aware at all times of issues that have occurred and thus be able to suitably deal with it. Anyway...

I then received a call from another gentleman (apologies I do not have any names, I have a couple wrote down at home but would not be able to pronounce) who advised me insurance would not cover it as it was outside the premises. He went on to say he has again spoken with the member of staff that dropped the goods, who, once again apologises and accepts liability, however is aware it will be a costly bill and cannot afford it. Even if it was £100 he says it is too much.

Papa Johns operates in and out of stores, dealing with the public on a continuous basis - as said, he was carrying out work duties, in work uniform etc etc when this occurred and so I would expect Public Liability (if not then some form of insurance) would cover it.

[FONT=arial, sans-serif]The car is a rare model, 1 of 50 and also has a paint work, which from the factory is roughly £1500. So I do not expect the cost of a new bonnet, painting and fitting will be cheap - which I certainly will not be covering the bill for![/FONT]

Please see the attached pictures - there are 3 dents - one the most obvious, a second above it and a third long one which then goes down to the wing. Also that whole side of the bonnet is dented and so no longer aligns with the wing/arch. I have looked into the option/cost of a dent removal specialist but have been told it will most likely not be possible due to where the dents are. It is dangerous to use body work filler on them as it is harder than metal and so more dangerous in even of an accident.

The Police were on scene at the time, so should you need any of the reference / case number then please say.

Please let me know how you plan to proceed.

Failure to do so I will seek legal assistance/action and will make contact with local papers.

Believe its a 3 stage process (acorrding to a friend who was in Dieppe watching at the factory) and has a 1.5K price tag for a reason rather than 'it looks good'...

Edited from google maps... but gives a better idea and how close he was to the store. Also they say "we cant cover as not on our premises" but surely if it wasn't theirs they couldnt advertise the sign (which is still up)


My csr was parked facing the fence thing along with about 6 or so other to my left parked the same way. The set of stairs he was heading for are to the left out of shot

he is in their employment and has caused damage in the course of his work to someones property - therefore they the company are liable...

its only like if he had driven in to your car...

Yeah, i posted on there as clearly some people with alot of money so assumed they would have some good input into all the legal area etc but so far the topic seems to have turned towards liquid yellow paint lol

Steve don't be silly you are claiming on their insurance just go through yours and get it sorted. They can dodge you all day long but WHEN they pay they will do it through their insurance and it will be recorded by your insurance as a result and you will have to declare it in future as a no fault claim.

its pointless pissing about as they won't just go in the till and hand you a fist full of scratty tenners.

If i go through mine though Admiral have told me my premium will increase, so i'd rather get it done by a dealership for example and they then invoice papa johns / papa johns insurers

haha! You caught me! I didn't have the time for liquid yellow, three stage process and I was just working with the 'fill' icon which only allows 1 stage! :smiley:
 
Don't think it will work that way mate but i'm just guessing tbh. I'd say you are still claiming on insurance one way or another. I'd have that checked legally.

Think I may call citizens advice tomorrow and also see if i get anywhere with the head office in the meantime. Will also keep on the stores case pushing them

Afterall, I'm going the the 'ring next week so need to get bits sorted for that. Id have to wait until after that for repairs to be done
