Oh totally agree, i'm not defending him and saying it's fine to rear end me, but accidents do happen, he could have been an arse and made it worse.
His insurance already rang and claimed liability.
Yes agreed about the bogus claims, why I didn't want to act like one of those people, why I was like "shall I claim or not?"
Depends if it has affected you? - i claimed because mine has made me a nervous driver and given me nightmares.

I guess it hasn't been that long for me, but I was driving properly gingerly all yesterday, especially going past the scene!
It's bad, as it's definitely knocked my confidence, which is actually making me drive worse, which I didn't think it would at all!!

Insurance companies urge you not to admit liability even if you were at fault. I really hope this is not a long drawn out affair and you are back behind a Clio RS again mate.

Yeah i've heard this, but they have admitted it and called to organise a courtesy car, but I had already organised one through my own insurance, so that's good I guess.
Thanks mate, yeah I hope it is this side of Christmas too, but like I said I don't want to rush to get into one.

Sorry to hear about this mate. Don't get disheartened by this bit of bad luck!
Don't give in to the insurance company till your happy with the figure either, I've been keeping my eye out the prices of the F1's recently as I might swap mine at some point next year and they seem to be quite high at the moment!
I can't see the F1's coming down in price ever, this will only go up as they get more rare. There is only 362 of 500 left on the road now.

Yep exactly, but insurance companies don't see that! It's so frustrating.

Sorry to hear this, such a shame too as looked like a lovely motor :worried:

Thanks mate, yeah it wasn't perfect bodywork wise, but mechanically it was! Trying to find another is going to be hard.

So I had the assessor call me, ended up a heated conversation as he told me:
"Colour is irrelevant"
Really....on a limited run car? Colour is paramount!
Then he sent me a link to a car that needed a cambelt and dephaser doing and didn't have the Milltek, so I said that, he said that information is irrelevant (PS I am insured through Brentacre as a brokers, all my declared mods are covered, so I have asked them to relay that to them).

So as people have mentioned, now the annoying back and forth starts :worried:

Yeah I've personally not had to go through this yet but I've heard it's a bitch of a process from everyone who's gone through it...

Anyway good luck with it mate, keep us updated

I take it the accessor is from the other guys insurance? Colour is irrelevant? So if you have Liquid Yellow or Alien Green (which were both £1200 extra on list price) this is not going to cost more to repair? Insurance companies are your best friend when taking your money but forget who you are when you really need them. I really do detest the no win no fee lawyers but these are the guys you want right now to save all the grief. They fight for every last penny so they get paid.

More shocking, this is MY INSURANCE assessor! I know right, meant to be on my side....my arse!
Yeah I tried that, he said "irrelevant".
Agreed, if he doesn't budge, I am going to contact my solicitor who is dealing with the loss of earnings and injury claim, see if they have anything they can do.

It's not helping I am trying to catch up with work, got a pounding headache, neck is sore too! Also my premium is going to go up next year, even if it isn't my fault....oh joy!

There's been some cracking advice on this thread - always good to have someone fighting your corner

It is good that the third party was decent about it all, but to be honest that's the least he could do! Accidents do happen, I agree, but a driver who was properly focused and driving to the conditions would not have rear-ended you like he has done. Your last post says it all - look at all the inconvenience this accident is causing you, not to mention the pain you have! Being nice doesn't excuse him - I have very little tolerance for poor drivers, especially those who cause crashes, regardless of how concerned they are afterwards - too little, too late

As much as you want it sorted quickly do not settle for anything less than you paid for it as its not had time to depreciate. You are paying an extra premium for having the F1 model so this must be considered. As said find as many ads with cars in similar condition as this is the market value that they are expected to pay out.

Wow I never expected it to be that low numbers, that's nearly a third of production cars gone/wrote off etc.

@suj It's really shitty what you're going through mate but honestly stick to your guns. I'm sure they're meant to get you the market value for a car in like for like spec/condition including service history (especially cambelt) etc.

What was the mileage etc on yours if you don't mind me asking ? I'll keep an eye out and see if I spot one of similar spec so you can show them it.

Oh totally agree, he shouldn't have crashed, but like I said was just an unfortunate situation, of course I am annoyed as I lost my car and having to fight my case to get money I shouldn't have to, I should just be paid out!
But I will be back in a 197, all that matters

Thanks mate, yep exactly, I am not giving up, I know my facts, backing them with evidence, the assessor can sense I am not backing down, i'm eating into their profits (as that means I have the courtesy car longer  )

Yeah I was shocked by how low the numbers were, so was the assessor, he is realising I am hitting him with hard numbers (numbers don't lie  )

Exactly that, I am saying all the maintenance is totally relevant, so in my last email to him I have sent in pics of all my paperwork with the car.

It did 95k, part of the problem he is trying to say none are at that mileage, so trying to take a massive wack, but the ones he is comparing haven't even had a cambelt (etc) done, so he doesn't realise how expensive this is, why I sent him all the invoices including the one from Jade Developments, so he again has hard numbers

Watch this space, as I don't back down

Seriously, you cannot make this s**t up.
So going home last night after work in peak traffic, standstill on M40, I get a tap from the woman behind (I was stopped, with handbrake on to put into perspective) on my bloody courtesy car!
The woman works in Purchasing at my company (massive company, I seen her parking pass in window).
The mark is tiny (on a 66 plate, 4k miled Corsa), but I took her details and went to Enterprise to cover my back, but the mark is so small they have said it's in the "wear and tear" limit, so I got that in writing.

Seriously my confidence in driving is at an all-time low, I am literally scared s**tless when anyone is near the rear of my car / pulls out in front of me, I thought i'd never be like this!

I think i'm buying a bus pass, knowing my luck i'd get walked into constantly!

OMG - How terrible.

Unfortunately as much as you can do all in your powers to allow for the idiots around you in this life....some still slip through the net in afraid.

Chin-up and carry on lad.

That is rotten luck, you must be absolutely fuming! Thankfully it wasn't as bad as the first time, but still...

I can appreciate how it's affected your confidence, I'm really not surprised after all that's happened to you recently! The best thing to do though is just keep on driving, it's the best way to get your confidence back. As Shuv says, there will always be some idiots on the road, however don't let these incidents put you off.

No way mate. I'm a biker and you are taught to ride defensively as people just don't see you. The more your ride these life skills creep into your driving and you notice so much more. They really are some complacent numpties out there on the roads. Try and make a positive out of this negative time you've had and don't let it make you a nervous driver, let this experience make you a better driver.
