Looking at vicarious liability / respondeat superior then PJ / store owner are the ones to be held liable so i'll be speaking to them again tomorrow.

I wasnt going to reply, but i looked at the profile and its all blank, just has a like for Papa Johns and thats it...

Which, to me, suggests they probably use that as a fake account to then comment on occasions and try to defend them selves so its not all negative comments against themselves.

Reckon we could get a group buy on painting, I need a 200T bonnet in LY as some pricks threw stones off a motorway bridge onto my car. Same colour as yours, bonnet irreparable.

Probably not to be honest as i cant imagine it would be high demand and so probably just the two of us. Also, I won't be the one doing it all / paying, I'll be leaving that for papa johns to sort out
 
But surely the paint shop would charge less if doing to parts at the same time rather than seperately. I didn't mean a literal group buy. Was just interested in any way to reduce costs for the both of us.

I didnt call them as a little progress was made. I said to papa johns uk that under vicarious liability / respondeat superior, PJ as the employer are liable to cover damages caused by an employee whilst undertaking work duties (which he was)

They came back to say that they had spoken with the store and have asked for the crime ref and my insurance details. Again spoke with the store today who, again just tried to brush off saying their insurance won't cover it.

Just said to him PJ is a company that operates on deliveries, thus out of a premises and in constant contact with members of the public...therefore their insurance would cover them, otherwise they are surely operating illegally as uninsured...he didnt really have much to say back and said he will check again tomorrow with the insurance company.

I then just said, its the right thing to do, if its what it take then I'll take them to court, but its not necessary and he will then just end up with bonnet costs plus court costs...its also time consuming and dragged out, which both of us could do without. However, if that must be done then i can easily pop down with a letter and costs required...

He said i can't as it must be against the employee, to which again i said no...against YOU the employer.

Will wait and see what he comes back with tomorrow
 
Sounds like you will get a result though.. not good they are trying to blame the employee

Dont most big companies do the same? I know my company wouldn't hesitate to throw me under a bus if they knew they could get away with it!

Good to see your getting somewhere Steve, sure they'll back down once they realise they can't wriggle out of it :smile:
 
even if the employee is "liable" he is working for the company and therefore its their responsibility due to his actions even if they are ultimately shall we say reckless actions then they have to deal with that as a discipline issue and not say "its not our fault" or "the employee has no money" - what a way to run a "business"!!!!!
 
Seen your thread on SP&L on Pistonheads, good to see you're making progress. The insurance thing is a red herring, they're either liable or not. If they are liable, their insurance may cover their liability, but that's their issue. If it doesn't cover them, and they are liable, then it has to come out of their own pocket. Do not assume that anyone knows what they are talking about - which I think you have uncovered upon having your conversation today!

So..an update on this

Spoken with the store again today, he said he is still fighting with the insurance company but they are being difficult - he accepts they are liable and wants to help us but the insurance company is just being a typical insurance company. Apologised and just said he is still battling but it takes time.

He the proposed another option..get it solved and we can just get on with our lives and that is to pay for approx half of the rate I said I had been quoted (from Carl / smithandroper) so he would give me a cheque for £700

I said, i like the offer as it gets it sorted, however im still left to find a good few hundred and i dont want to be paying anything... Told him i had a discount quote not going down the insurance rout for £800 but it means travelling to Yorkshire. Ive then got fuel costs there/back, miles added to the car, plus im guessing it wont be done within a day so i'll probably have to stay up there a few days...

His offer of paying £700 still stands, i'll see what quotes i get down this way and if a dent repair is possible for a lot less. One guy i approached so far said he can easily do it and repair, the only problem is trying to match the paint

Got another guy coming to look at the car tomorrow so see what he says
 
He's taking the piss basically. I'm actually starting to wonder if they're insured...I would speak to CA now. Put your case across and find out whether you are within your rights who they are insured with and if you can request case details or something like that.

Makes you wonder but then he could be genuine..insurance companies are such a pain in to booty to deal with...he wants it sorted so he can get on with running his business and i want it sorted. So it seems his offer of paying out his own pocket is genuine. He will then recover from the employee over time

Be nice if i can get a body specialist to repair for a couple of hundred then i pocket 500...
 
No respectable company would do that. Would you boss bail you out for 700 notes out of his own pocket? like fook. You do a runner and he's 700notes out of pocket.

Any company would go through insurance, thats what they have it for. He'd still have to pay his excess anyway.
